Please read the Jetabroad Terms and Conditions ("Terms and Conditions")
carefully before using this site.
By using this site, you unconditionally agree and accept to be legally bound by
the Terms and Conditions. If you do not agree with any part of the Terms and Conditions,
you must not use this site.
Most products and services (such as airline tickets) have their own specific governing
terms and conditions which shall apply in addition to the Terms and Conditions.
A summary of these additional terms and conditions may be available during the purchase
process, or in other parts of this site. Questions regarding additional terms and
conditions relating to the product or service purchased, not explicitly shown on
the site, should be directed to Jetabroad Customer Service.
1. Use of site
Jetabroad Pty Limited ("Jetabroad") grants you a limited, non-exclusive,
non-transferable right to use this site in accordance with the Terms and Conditions.
By using the site, you agree to:
- Only use the Jetabroad site to make legitimate reservations or purchases and
shall not use this site for any other purposes, including without limitation, to
make any speculative, false or fraudulent reservation
- Provide legitimate contact information, not limited to, but including e-mail
address(es), delivery address, telephone number(s), and passenger details
- Not, except as permitted under applicable law, copy, reproduce, republish, upload,
post, transmit distribute or otherwise communicate to the public any of the content
provided in this site, including the text, graphics, button icons, audio and video
clips, digital downloads, data compilations and software, without the prior written
permission of Jetabroad
- Not use any automated device, program, or algorithm to copy any of the web pages,
data or content found on this site
- Not modify, translate, decompile, adapt, disassemble, reverse engineer or create
derivative works from any content or component from this site
- Not reproduce any part of this site without the expressed written permission
of Jetabroad
- Not transmit any information that contains a virus, bug, worm, Trojan horse,
or any other potentially harmful item.
2. Site registration
Use of this site may require you to register and provide certain data. In consideration
of Jetabroad allowing you to use the site, in registering and providing such data,
you represent and warrant that the information about you is true, accurate, current,
and complete.
3. Privacy
You should familiarise yourself with the Jetabroad Privacy Policy.
4. Age
By using this site, you represent that you are of legal age to use this site and
to create binding legal obligations for any liability you may incur as a result
of the use of this site. You understand that you are financially responsible for
all uses of this site by you and those using your login information.
5. Online purchases
Jetabroad acts as agent for its third party providers and distributors for all products
and services purchased by you on this site. You may make purchases of on-line products
and services online on this site.
Please note that by indicating your acceptance to purchase any product or service
offered on the site, you are obliged to complete such transactions. You are prohibited
from indicating your acceptance to purchase products and services where you do not
intend to complete such transactions.
By completing a purchase, you agree that you will be bound by the additional terms
and conditions imposed by the travel service providers for whom Jetabroad acts as
an agent.
Jetabroad is not liable for any claims against non-performance or unsatisfactory
performance of any third party product provider for whom Jetabroad acts as an agent.
Jetabroad is not liable for the cessation of service, or declaration of bankruptcy
by any third party provider, including airlines. By agreeing to these terms and
conditions, you agree that any claims arising from the cessation of service, or
declaration of bankruptcy by any third party provider will not be directed at Jetabroad
and that you will not raise a charge back against Jetabroad through your credit
card issuing bank or other merchant facility provider (e.g. Paypal). In the unlikely
event your travel plans are affected by a third party cessation of service, Jetabroad
will assist you with alternate plans, or in attempting to recover your funds from
the third party provider.
All prices are subject to change until full payment is made and are subject to airline
or travel service provider availability.
If you are purchasing in a currency other than the currency related to your credit
card, it is likely your financial institution may charge a currency conversion fee,
generally between 1 and 3% of the total amount charged.
Consistent with Jetabroad's general pricing policy, prices for low cost carriers
include all taxes and fees during the booking process. Where a low cost carrier
flight airfare is purchased in a currency other than the currency related to your
credit card it is likely your financial institution will charge you a 1-3% currency
conversion fee on the total amount charged. Fares are quoted in the applicable foreign
currency with a courtesy conversion provided. Although this conversion is accurate
at the time of booking, the actual amount charged to your credit card vary slightly
due to:
- Any currency fluctuation upwards or downwards between the time of booking and the
time of ticketing by the airline
- Your financial institution charging a currency conversion fee, generally between
1 and 3% of the ticket price.
In a limited number of circumstances and generally within 24 hours of a reservation
being made, travel providers may reject reservation(s) made by you through the Jetabroad
website. In such circumstances, Jetabroad will use best endeavours to provide you
a viable alternative at the same or lower price than the originally quoted price.
If, despite best endeavours, Jetabroad is unable to secure a viable alternative,
Jetabroad will refund any amounts previously charged to your credit card. Jetabroad's
only obligation in such a circumstance will be to use best endeavours to provide
you a viable alternative, or to refund any amounts already charged to your credit
card.
As airlines occasionally have last minute schedule changes, Jetabroad strongly recommends
you reconfirm each of your flights with the airline(s) you are travelling on 2-3
days prior to your scheduled departure. Some airlines require telephone reconfirmation.
For those airlines, failure to do so may result in your reservation being cancelled.
Non-transactional information provided on the Jetabroad site (such as destination information)
is supplied in good faith and should be treated as a guide only.
Assuring that all documentation and health requirements are met is the sole responsibility
of the individual traveller.
6. Changes and cancellations
Terms and conditions for changes or cancellation of bookings and purchases will
vary from product to product and service to service.
Generally, all reservations for products and services purchased on the Jetabroad
site will incur penalties and/or fees for changes and/or cancellations, imposed
by product providers, as well as Jetabroad.
Airline websites provide conditions of carriage, including terms and conditions for schedule changes and other flight disruptions.
If an airline ticket is refundable, the total cost to cancel will include any applicable Airline charges and Jetabroad's fees. Jetabroad provides refund estimates based on its interpretation of fare rules, however the final amount is determined by the airline. The refundable amount (less Jetabroad fees) will be sent to the original account provided as a form of payment once the airline has processed the refund and returned the monies paid to Jetabroad. Airline refund payment processing can take from 4 to 12 weeks, with longer time frames for some airlines.
Many airfares are non-changeable and non-refundable altogether. Other airfares allow
changes at a fee, but are still non-refundable. Jetabroad booking fees are non-refundable.
Jetabroad will make every effort to advise you of change and/or cancellation penalties
during the booking process. However, if information displayed on the website is
incomplete or absent, you should contact Jetabroad Customer Service for clarification.
You should not complete a booking if you are uncomfortable with the information
provided, or if you have not ascertained to your satisfaction what cancellation
and/or change penalties apply to the reservation you are about to complete.
7. Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW AND SUBJECT TO THE STATUTORY WARRANTIES BELOW,
JETABROAD PTY LIMITED MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND REGARDING
THIS SITE, PRODUCTS OR SERVICES ON THIS SITE AND/OR ANY MATERIALS PROVIDED ON THIS
SITE, ALL OF WHICH ARE PROVIDED ON AN "AS IS" BASIS ONLY. JETABROAD PTY
LIMITED DOES NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF
ANY OF THE CONTENT OR DATA FOUND ON THIS SITE AND, SUBJECT TO THE STATUTORY WARRANTIES
BELOW, EXPRESSLY DISCLAIMS ALL WARRANTIES, TERMS AND CONDITIONS, INCLUDING ALL IMPLIED
WARRANTIES, TERMS AND CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS
FOR A GENERAL OR PARTICULAR PURPOSE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS,
AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR
USAGE OF TRADE TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF NEW SOUTH WALES, AUSTRALIA.
JETABROAD PTY LIMITED DOES NOT WARRANT THAT THIS SITE, ITS SERVERS OR ANY E-MAIL
SENT FROM JETABROAD PTY LIMITED ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Statutory Warranties
Certain legislation (including the Trade Practices Act 1974) may imply warranties
or conditions or impose obligations which cannot be excluded, restricted or modified
except to a limited extent. These Terms and Conditions must be read subject to any
such statutory provisions. If such statutory provisions apply, to the extent to
which JETABROAD PTY LIMITED is entitled to do so, the liability of each will be
limited at their option to:
(a) in the case of supply of goods, the replacement of the goods or supply of equivalent
goods, the payment of the cost of replacing the goods or acquiring equivalent goods,
the payment of the cost of having the goods repaired or the repair of the goods,
and
(b) in the case of services, the supply of the services again, or the payment of
the cost of having the services performed again.
8. Copyright and intellectual property
All intellectual property on the website is owned by Jetabroad Pty Limited. This
includes materials protected by copyright, trademark, or patent laws. The content
in the website, including but not limited to text, graphics or code is a collective
work under Australian and other copyright laws; All rights reserved. All trademarks,
service marks and trade names (e.g., the Jetabroad name, the boomerang device) are
trademarks or registered trademarks of Jetabroad Pty Limited. Unauthorised use is
strictly prohibited.
9. Limitation of liability
TO THE FULL EXTENT PERMITTED BY LAW, JETABROAD PTY LIMITED ASSUMES NO RESPONSIBILITY,
AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER
EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, OR BROWSING IN
THIS SITE OR YOUR DOWNLOADING OF ANY MATERIALS, DATA, TEXT, IMAGES, VIDEO OR AUDIO
FROM THE SITE.
IN NO EVENT SHALL JETABROAD PTY LIMITED BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE,
OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES
OF ANY KIND OR FOR ANY LOST PROFITS OR LOST SAVINGS, WHETHER BASED IN CONTRACT,
TORT (INCLUDING NEGLIGENCE), EQUITY, STRICT LIABILITY, STATUTE OR OTHERWISE, WHICH
ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH: (I) ANY USE OF THIS SITE OR CONTENT
FOUND HEREIN, (II) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF
OR INABILITY TO USE ANY COMPONENT OF THIS SITE FOR RESERVATIONS OR TICKETING), OR
(III) THE PERFORMANCE OR NON PERFORMANCE BY JETABROAD PTY LIMITED EVEN IF JETABROAD
PTY LIMITED HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY
OTHER PARTY.
If, notwithstanding the foregoing, Jetabroad should be found liable for any loss
or damage which arises out of or is in any way connected with any of the above described
functions or uses of this site or its content, to the full extent permitted by law
the combined aggregate liability of Jetabroad shall in no event exceed the value
of the goods and services purchased by you that are the subject of the dispute or
A$1000.00, whichever is lower. Further, Jetabroad's liability to you in contract,
tort, negligence, strict liability, under statute or otherwise will be reduced to
the extent, if any, to which you contributed to the loss or damage. In its sole
discretion, in addition to any other rights or remedies available to Jetabroad without
any liability whatsoever, Jetabroad may, at any time and without notice, terminate
or restrict your access to and/or of any component of this site. Some territories
do not allow limitation of liability, so to that extent the foregoing limitation
may not apply to you.
10. Indemnification
You shall defend and indemnify Jetabroad and its officers, directors, employees
and agents from and against any claim, cause of action or demand, including without
limitation, reasonable legal and accounting fees, brought by or on your behalf in
excess of the liability described herein or by third parties as a result of your
use of this site.

This site may contain links to other web sites which are not maintained by Jetabroad
and which are provided solely as a convenience to you and not as an endorsement
of the contents of such other web sites (whether express or implied) by Jetabroad.
Jetabroad has not reviewed all of the linked web sites and shall not be responsible
for the content of any other web sites and make no representation or warranty regarding
any other web sites or the contents or materials on such web sites. If you decide
to link to other web sites, you do so at your own risk and subject to the terms
and conditions (if any) of the linked web site and in particular, its own set of
privacy policies that you are advised to review.
Similarly, other web sites may also link to this site. Any third parties that wish
to establish links with this site should obtain the prior written consent of Jetabroad
to do so and Jetabroad reserves the right to deny permission for any such links
to the site. In particular, no third parties shall deep link to any page other than
the Home page of this site without obtaining the prior written consent of Jetabroad
to do so. If, however, Jetabroad gives its permission for any such links, Jetabroad
is not under any obligation to establish reciprocal links with the third party.
12. Relationship
The relationship between Jetabroad and you will be that of independent contractors,
and neither of us nor any of our respective officers, agents or employees will be
held or construed to be partners, joint ventures, fiduciaries, employees or agents
of the other.
13. Governing law
The Terms and Conditions, its performance and all disputes arising out of or in
connection with the Terms and Conditions shall be governed by the laws of the state
of New South Wales, Australia. You hereby consent and submit to the non-exclusive
jurisdiction of the courts of the state of New South Wales in all questions and
controversies arising out of or in connection with the Terms and Conditions, its
performance and your use of this site.
14. Legal fees and other legal expenses
If Jetabroad or any its affiliates take any action to enforce the Terms and Conditions,
such parties will be entitled to recover from you, and you agree to pay, all legal
fees and expenses and any cost of litigation, in addition to any other relief, at
law or in equity, to which such parties may be entitled.
15. Injunctive relief
You acknowledge that a violation or attempted violation of any of the Terms and
Conditions will cause such damage to Jetabroad as will be irreparable, the exact
amount of which would be difficult to ascertain and for which there will be no adequate
remedy at law. Accordingly, you agree that Jetabroad shall be entitled as a matter
of right to an injunction (including a temporary injunction) issued by any court
of competent jurisdiction, restraining such violation or attempted violation of
these terms and conditions by you, or your affiliates, partners, or agents, as well
as to recover from you any and all costs and expenses sustained or incurred by Jetabroad
in obtaining such an injunction, including, without limitation, all legal fees and
expenses.
16. Termination
Jetabroad may terminate the Terms and Conditions and/or the provision of any of
the products and services at any time for any reason, including any improper use
of this site or your failure to comply with the Terms and Conditions. Such termination
shall not affect any right to relief to which Jetabroad may be entitled, at law
or in equity. Upon termination of the Terms and Conditions, all rights granted to
you will terminate and revert to Jetabroad and its third party providers or distributors,
as applicable.
17. Assignment
You may not assign, convey, subcontract or delegate your rights, duties or obligations
hereunder.
18. Modification
Jetabroad may at any time modify any part of the site, including the products and
services and the Terms and Conditions at its sole discretion without prior notice
and your continued use of this site will be conditioned upon the terms and conditions
in force at the time of your use. Jetabroad also reserves the right to deny any
person access and use of the site at any time.
19. Additional terms
Additional terms and conditions may apply to reservations, purchases of products
and services and other uses of portions of this site, and you agree to abide by
such other terms and conditions, including additional terms and conditions that
apply in relation to specific products and services.
20. Severability
The Terms and Conditions shall be severable. In the event that any provision is
determined to be unenforceable, illegal or invalid, such provision shall nonetheless
be enforced to the fullest extent permitted by applicable law, and such determination
shall not affect the enforceability, legality and validity of any other remaining
provisions.
21. Entire agreement
The Terms and Conditions, together with any terms and conditions incorporated herein
or referred to herein, constitute the entire agreement between us relating to the
subject matter hereof, and supersede any prior understandings or agreements (whether
oral or written) regarding the subject matter, and may not be amended or modified
except in writing or by making such amendments or modifications available on this
site.
